The above-captioned matter was heard as a contested case on July 20, 2000, at which time the complainant and respondent appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint.  At such time and upon request of the parties, the hearing officer continued this matter to allow the parties to attempt settlement of the complaint. The parties appeared at the continued hearing on August 10, 2000, at which time they informed the Commission that they had reached the terms of an agreement in settlement of this matter.  Accordingly, the complainant withdrew her complaint.  The parties also stipulated that, should their agreement be breached in the future, the complainant is not precluded from making another request for the records at issue and, if denied access to such records by the respondent, filing another complaint with the Commission.

 

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

            1.  The complaint is hereby dismissed without prejudice.

 

            2.  The Commission commends both parties for reaching a non-litigated settlement of this matter.
