The above-captioned matter was scheduled to be heard
as a contested case on June 15, 1999, at which time the complainant and the
respondents appeared, and reached an agreement in an attempt to resolve the
complaint without a hearing.
Based
on the agreement, the complainant informed the Commission that he would
withdraw his complaint if the respondents provided him with redacted copies of
certain legal invoices. It was
the understanding of the parties and the hearing officer that the only
permissible changes to be made to the invoices as they exist in the files of
the respondents would be redactions to details concerning the nature of the
work performed.
The parties and the hearing officer further
understood that the following information, if contained on the invoices as
they exist in the respondents’ files, would not be redacted:
a) the date the work was performed, b) the initials of the attorney
performing the work, c) the case name pertaining to the work being performed,
d) the number of hours worked, e) the hourly rate billed and f) the total
amount billed.
At its
regular meeting of August 11, 1999, the Commission voted to reopen the
above-captioned matter for the purpose of conducting an in camera
inspection of the records at issue, and specifically, to determine the
redactions that would be in keeping with the above-mentioned agreement.
The respondents submitted the records at issue to the
Commission and following an in camera inspection of such records
the Commission finds the following:

the records at issue consist of 81 pages designated in camera
records page 1 through page 81, inclusive, for identification purposes;

keeping with the above-mentioned agreement, pertain only to the details
concerning the nature of the legal service performed, and are set forth more
