The above-captioned matter was scheduled to be heard as a contested case on May 30, 2000, at which time the complainant and the respondents appeared and resolved the complaint without the need for a hearing. Specifically, on May 30, 2000, the respondents provided the complainant with certain redacted records responsive to his request, and acknowledged that due to the complexities involved in processing his request there was some delay in timely providing the records to the complainant. Based on the foregoing the complainant withdrew the complaint.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. The complaint is dismissed.
2. The Commission commends the
parties on having reached a non-litigated resolution of this complaint.
