The above-captioned matter was heard as a contested case on November 19, 1999, at which time the complainant and the respondents appeared and stipulated to certain facts.

After consideration of the entire record, the following facts are found and conclusions of law are reached:

            2.  By letter dated July 16, 1999, the complainant requested of the respondent executive director that the complainant be permitted to inspect (a) all correspondence with outside agencies about no loitering signs on Kennedy Avenue, (b) any legal opinions about loitering or trespassing, (c) any records created by employees of the Housatonic Area Regional Transit (“HART”) about loitering or trespassing on Kennedy Avenue or elsewhere, (d) any work orders for putting up signs on Kennedy Avenue, (e) all correspondence with outside agencies about a bus and trolley sticker sign on Main Street in front of CVS, (f) any legal opinions about such sign, (g) any records created by employees of HART about such sign, and (h) any work orders for putting up the sign at CVS on Main Street in Danbury.

            3.  Having received no response to the foregoing request, the complainant appealed to the Commission by letter dated August 26, 1999, and filed with the Commission on September 14, 1999.

4.  At the hearing on this matter, counsel for the respondents represented that the respondents have no records responsive to the complainant’s request.  The complainant acquiesced in this representation and agreed not to prosecute his complaint.
