		Respondents	December 8, 1999

            The above-captioned matter was scheduled to be heard as a contested case on September 21, 1999, at which time the complainants and the respondents appeared in order to present testimony and argument on the complaint.

 

At an informal conference prior to the September 21, 1999 hearing, the complainants and the respondents reached the terms of an agreement in resolution of this contested case. The respondents agreed that they took up business at a special meeting on June 30, 1999 beyond the call of the notice for that meeting, contrary to the provisions of §1-225(a) of the Freedom of Information Act. The respondents also agreed that henceforth they will comply with the letter and the spirit of all aspects of the Freedom of Information Act. Based upon this agreement, the complainants informed the Commission that they wished to withdraw their complaint.

 

            The Commission commends the respondents for their good faith approach to the resolution of this complaint.

 

            The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

            1.  The complaint is hereby dismissed.
