The above-captioned matter was heard as a contested
case on September 16, 1999, at which time the complainant and the respondents
appeared and agreed to settle the complaint.
Pursuant to their settlement, an ombudsman from the Commission
inspected the records that were the subject of this matter and made a
determination as to which records were permissibly exempt from disclosure; the
parties agreed to accept the determination of the ombudsman; the respondents
thereafter provided the complainant with copies of all the non-exempt records;
and the complainant advised the undersigned hearing officer that he wished to
withdraw his complaint.
The
following order by the Commission is hereby recommended on the basis of the
record concerning the above-captioned complaint.
1. The complaint is hereby
dismissed.
