FREEDOM OF INFORMATION COMMISSION
OF THE STATE OF CONNECTICUT

In the Matter of a Complaint by FINAL DECISION
Gale Courey Toensing,
Complainants
against Docket #FIC 1999-153
Sergeant, State of Connecticut, Department of
Public Safety, Office of the Commissioner;
State of Connecticut, Department of Public Safety,
Office of the Commissioner; and William Pagoni,
Respondents July 28, 1999

        The heading of the above-captioned matter has been amended and restated in order to reflect the granting of party status to Lt. William Pagoni. The matter was scheduled to be heard as a contested case on May 19, 1999, at which time the complainant and the respondents appeared in order to present testimony and argument on the complaint.

        At an informal conference prior to the May 19, 1999 hearing, the complainant and the respondents reached the terms of an agreement in resolution of this contested case. The parties agreed that the respondents would furnish to the complainant a copy of both the summary of the investigation of Lt. William Pagoni and the record of the penalty imposed on Lt. Pagoni as a result of the investigation. Based upon this agreement, the complainant informed the Commission that she wished to withdraw her complaint.

        The Commission warmly commends both the complainant and the respondents for working successfully to negotiate a non-litigated settlement of their earlier differences.

        The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

        1. The complaint is hereby dismissed.

        Approved by Order of the Freedom of Information Commission at its regular meeting of

July 28, 1999.
