Respondents June 30, 1999

        The above-captioned matter was scheduled to be heard as a contested case on May 4, 1999 at which time the complainant and the respondents appeared and reached the following agreement in resolution of the complaint: the respondent corporation counsel agreed to promptly provide to the complainant a random listing of the test scores, including, the individual score received for each component of the test. Based on the representation of the respondent corporation counsel the complainant indicated that he wished to withdraw his complaint.

        The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

        1. The complaint is dismissed.

        2. The Commission commends both parties for their role in arriving at a non-litigated resolution of this complaint.
