The above-captioned matter was scheduled to be heard as a contested case on April 26, 1999, at which time the complainants and the respondents appeared in order to present testimony and argument on the complaint.

        At an informal conference prior to the April 26, 1999 hearing, the complainants and the respondents reached the terms of an agreement in resolution of this contested case. The parties agreed that the respondents would furnish to the Saley family all forty three photographs relating to the death of Joseph Saley, at a charge of $5.00 per photograph, and would also furnish to the complainants within seven days a copy of the nurse’s notes pertaining to the medical treatment of Joseph Saley on or about April 30, 1998. Based upon this agreement, the complainants informed the Commission that they wished to withdraw their complaint.

        The Commission warmly commends both the complainants and the respondents for working successfully to negotiate a non-litigated settlement of their earlier differences.

        The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

        1. The complaint is hereby dismissed.
