The above-captioned matter was scheduled to be heard as a contested case on February 1, 1999, at which time the complainant and the respondent reached the terms of an agreement in resolution of this contested case. The parties agreed that the respondent would provide to the complainant a copy of the investigation report relative to an allegation of discrimination lodged against the complainant, which record was the subject of the complaint in this matter. The parties also agreed that the respondent may redact one sentence and one page from such report. The parties also agreed that the report would be provided to the complainant, at no cost, on the morning of February 2, 1999. Finally, the parties agreed that, in consideration of the foregoing, the complainant would withdraw her complaint in this matter.

        The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

        1. The complaint is hereby dismissed.

        2. The Commission commends both parties for reaching a non-litigated settlement of this matter.
