The above-captioned matter was
scheduled to be heard as a contested case on September 30, 1999, at which time
the respondents appeared, however, the complainant failed to appear to
prosecute the complaint.
The
following order by the Commission is hereby recommended on the basis of the
record concerning the above-captioned complaint:
1. The complaint is hereby dismissed.
2. The Commission notes that the complainant’s
failure to appear at the scheduled hearing, and failure to notify the
Commission that he would not attend, has caused the state’s valuable and scarce
resources to be wasted in the preparation of the hearing.
