	The above-captioned matter was scheduled to be heard as a contested case on July 
6, 1998, at which time the complainant and the respondent appeared in order to present 
testimony and argument on the complaint. 
At an informal conference prior to the July 6, 1998 hearing, the complainant and 
the respondent reached the terms of an agreement in resolution of this contested case, 
wherein the parties agreed that the respondent will comply with the letter and the spirit of 
all aspects of the Freedom of Information Act. In this connection, the respondent will post 
on a bulletin board in a public place in city hall a brief statement of its policy of adhering 
to the Freedom of Information Act and will include as part of such statement quotations of 
the first and third sentences of §1-19(a), G.S. Based upon this agreement, the complainant 
informed the Commission that he wished to withdraw his complaint.
	The Commission warmly commends both the complainant and the respondent for 
working successfully to negotiate a non-litigated settlement of their earlier differences.
	The following order by the Commission is hereby recommended on the basis of the 
record concerning the above-captioned complaint:
	1.  The complaint is hereby dismissed.
