The above-captioned matter was scheduled to be heard as a contested case on March 18, 1998, at which time the complainant and the respondents appeared in order to present testimony and argument on the complaint. At an informal conference prior to the March 18, 1998 hearing, the complainant and the respondents reached the terms of an agreement, whereby the complainant received the records at issue in this contested case. Based upon this agreement, the complainant informed the Commission that he wished to withdraw his complaint.

        The Commission commends both the complainant and the respondent for working successfully to negotiate a non-litigated settlement of their earlier differences.

        The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

        1. The complaint is hereby dismissed.
