        The above-captioned matter was scheduled to be heard as a contested case on March 13, 1998, at which time the complainant and the respondents appeared in order to present testimony and argument on the complaint.

        At an informal conference prior to the March 13, 1998 hearing, the complainant and the respondents reached the terms of an agreement in resolution of this contested case, wherein the respondents provided certain records to the complainant. Based upon this agreement, the complainant informed the Commission that he wished to withdraw his complaint.

        The Commission warmly commends both the complainant and the respondents for working successfully to negotiate a non-litigated settlement of their earlier differences.

        The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

        1. The complaint is hereby dismissed.
