        The above-captioned matter was scheduled to be heard as a contested case on March 4, 1998, at which time the complainant and the respondent appeared in order to present testimony and argument on the complaint.

        At an informal conference prior to the March 4, 1998 hearing, the complainant and the respondent reached the terms of an agreement in resolution of this contested case, wherein the parties agreed that, because the respondent was not aware that FOI requirements applied to all of its committees and subcommittees, there was, due to oversight, a technical violation of the notice requirement in connection with the meeting of the Griffin Line Subcommittee on November 17, 1997, and the parties also agreed that henceforth the respondent will comply earnestly with the letter and the spirit of all aspects of the Freedom of Information Act.

        The Commission warmly commends both the complainant and the respondent for working successfully to negotiate a non-litigated settlement of their earlier differences.

        The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

        1. The complaint is hereby dismissed.
