Docket #FIC 1997-379

Zoning Agent, Planning and Zoning Office, Town of Willington; Assistant Zoning Agent, Planning and Zoning Office, Town of Willington; and Town of Willington,

Respondents

April 22, 1998

The above-captioned matter was scheduled to be heard as a contested case on March 2, 1998, at which time the complainant and the respondents appeared in order to present testimony and argument on the complaint.

At an informal conference prior to the March 2, 1998 hearing, the complainant and the respondent reached the terms of an agreement in resolution of this contested case, wherein the parties agreed that there was a technical violation of the requirement that public records be in "an accessible place" in the regular office or place of business of the relevant public agency, and also that henceforth the respondents will comply with the letter and the spirit of all aspects of the Freedom of Information Act, and in this connection, will post on their public notice bulletin board the first sentence and the first portion of the third sentence of § 1-19(a), G.S. (concluding with the words "in an accessible place"). Based upon this agreement, the complainant informed the Commission that she wished to withdraw her complaint.

The Commission warmly commends both the complainant and the respondents for working successfully to negotiate a non-litigated settlement of their earlier differences.

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

        1. The complaint is hereby dismissed.

Approved by Order of the Freedom of Information Commission at its regular meeting of April 22, 1998.
