        The above-captioned matter was scheduled to be heard as a contested case on January 12, 1998, at which time the complainants and the respondent appeared in order to present testimony and argument on the complaint. At an informal conference prior to the January 12, 1998 hearing, the complainants and the respondent reached the terms of an agreement in resolution of this contested case.

        With reference to the respondent’s meeting of November 10, 1997, the parties agreed that: 1) the complainants maintain that there was a Freedom of Information Act violation as they alleged; and that 2) the respondent denies that there was any such violation. The parties further agreed that henceforth the respondent will not require those in attendance to sign-in at its meetings, as recommended by the January 6, 1998 letter from the respondent’s counsel to the respondent. Based upon this agreement, the complainants informed the Commission that they wished to withdraw their complaint.

        The Commission warmly commends both the complainants and the respondent for working successfully to negotiate a non-litigated settlement of their earlier differences.

        The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

        1. The complaint is hereby dismissed.
