The above-captioned matter was scheduled to be heard as a contested case on December 2, 1997 at 11:30 A.M, at which time the respondent appeared but the complainant did not. The respondent stated at that time that, under cover letter dated November 21, 1997, he had provided the complainant with a copy of the record that was the subject of this complaint.

        The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

        1. The complaint is hereby dismissed for failure to prosecute.
