Docket #FIC 1997-278

Chief Officer, Plants and Maintenance, Board of Education, City of New Haven,

Respondents

February 18, 1998

The above-captioned matter was scheduled to be heard as a contested case on December 10, 1997, at which time the complainants and the respondent appeared in order to present testimony and argument on the complaint.

At an informal conference prior to the December 10, 1997 hearing, the complainants and the respondent reached the terms of a settlement in resolution of this contested case, wherein the independent contractor of the respondent, Honeywell Corporation, represented that it has furnished the records requested by the complainants to the Compliance Office of the City of New Haven, c/o Mr. Bill Wilson, and the complainants agreed that they should be able to inspect the requested records at said Compliance Office. Based upon these representations and expectations, the complainants informed the Commission that they wished to withdraw their complaint.

The Commission warmly commends both the complainants and the respondent for working successfully to negotiate a non-litigated settlement of their earlier differences.

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

        1. The complaint is hereby dismissed.

Approved by Order of the Freedom of Information Commission at its regular meeting of February 18, 1998.
