            The above-captioned matter was scheduled to be heard as a contested case on December 11, 1997, at which time the complainant and the respondent appeared in order to present testimony and argument on the complaint. The caption shown above has been amended in order to reflect the accurate legal name of the respondent.

 

At an informal conference prior to the December 11, 1997 hearing, the complainant and the respondent reached the terms of an agreement in resolution of this contested case. The parties agreed that there was a violation of the requirement to timely file minutes in connection with the respondent’s meeting of August 26, 1997, that an amended complaint offered by the complainant would be made a part of the record as complainant’s Exhibit A, and also that henceforth the respondent will comply with the letter and the spirit of all aspects of the Freedom of Information Act, including with reference to the timely filing of minutes. Finally, the respondent and the complainant mutually agreed to work toward a relationship of confidence and cordiality in their shared involvement in town governance.

 

Based upon this agreement, the complainant informed the Commission that he wished to withdraw his complaint.

 

            The Commission warmly commends both the complainant and the respondent for working successfully to negotiate a non-litigated settlement of their earlier differences.

 

            The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

            1.  The complaint is hereby dismissed.
