            The above-captioned matter was heard as a contested case on November 5, 1997, at which time the complainant and the respondents appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint.

 

            After consideration of the entire record, the following facts are found and conclusions of law are reached:

 

            1.  The respondents are public agencies within the meaning of §1-18a(a), G.S.

 

            2.  By letter dated July 26, 1997, the complainant requested that the respondent tax collector provide him a copy of all procedures established as required by §§4-193(h)(1), 4-193(h)(2), and 4-193(h)(3), G.S.

 

            3.  It is found that the respondent does not maintain records responsive to the complainant’s request.

 

            4.  Upon learning that the respondent did not maintain any records responsive to his request, the complainant indicated that he wished to withdraw his complaint.

 

            The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

1.  The complaint is hereby dismissed. 

 

2.  The Commission wishes to commend the complainant for acting to resolve this matter during the November 5, 1997 hearing.
