The above-captioned matter was scheduled to be heard as a contested case on November 7, 1997, at which time the complainant and the respondents appeared, and agreed to settle their dispute.  The following are the terms of such agreement:

 

The respondents acknowledge that with respect to the respondent board’s July 7, 1997 regular meeting (“the meeting”) they technically violated §1-21(a), G.S., by amending the agenda of the meeting on the morning of July 7, 1997 and by not obtaining a two-thirds vote prior to taking up certain items not on the meeting agenda.

 

The respondents further indicated that they will attempt to comply with the provisions of §1-21(a), G.S., in the future.

 

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

1.  The complaint is dismissed.

 

2.  The Commission commends the parties in this matter in successfully resolving their earlier differences.
