The
above-captioned matter was heard as a contested case on September 23 and
October 14, 1997, at which times the complainant and the respondents appeared
in order to present testimony and argument on the complaint.
During a recess of the
September 23, 1997 hearing, the complainant and the respondent reached the
general terms of an agreement in resolution of this contested case. At the
continued hearing on October 14, 1997, respondents’ counsel represented that
the respondents did not have in their custody certain records which were within
the scope of the complainant’s request. Following this representation, the
complainant informed the Commission that he wished to withdraw his complaint.
The
Commission warmly commends both the complainant and the respondents for working
successfully to negotiate a non-litigated settlement of their earlier
differences.
The
following order by the Commission is hereby recommended on the basis of the
record concerning the above-captioned complaint:
1. The complaint is hereby dismissed.
