            The above-captioned matter was scheduled to be heard as a contested case on October 15, 1997, at which time the complainant and the respondents appeared in order to present testimony and argument on the complaint.

 

At an informal conference prior to the October 15, 1997 hearing, the complainant and the respondents reached the terms of an agreement in resolution of this contested case, wherein the parties agreed that the complainant would waive his requests for records containing information concerning the identity of other applicants for the position of public health sanitarian, and also that the respondent will furnish records to the complainant concerning the application process for public health sanitarian, except for: a) legitimate test questions and scoring keys used to administer the examination for employment for public sanitarian; and b) information concerning the identity of other applicants for the position of public health sanitarian. The respondents will use redaction of the names of other applicants as the method to provide the greatest amount of information within the terms of this agreement. Based upon the agreement, the complainant informed the Commission that he wished to withdraw his complaint.

 

            The Commission warmly commends both the complainant and the respondents for working successfully to negotiate a non-litigated settlement of their earlier differences.

 

            The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

            1.  The complaint is hereby dismissed.
