In the Matter of a Complaint by Philip W. Stull, Complainant
against
Board of Finance, Town of Branford, Respondent

The above-captioned matter was scheduled to be heard as a contested case on September 19, 1997, at which time the complainant and the respondent appeared in order to present testimony and argument on the complaint.

At an informal conference prior to the September 19, 1997 hearing, the complainant and the respondent reached the terms of an agreement in resolution of this contested case, wherein the respondent agreed to comply in the future with the letter and the spirit of the Freedom of Information Act and expressed regret that misunderstandings had occurred in the past. Based upon this undertaking, the complainant informed the Commission that he wished to withdraw his complaint.

The Commission warmly commends both the complainant and the respondent for working successfully to negotiate a non-litigated settlement of their earlier differences.

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

1. The complaint is hereby dismissed.
