The
above-captioned matter was heard as a contested case on April 30, 1996, at
which time the complainants and the respondent appeared, stipulated to certain
facts and presented testimony, exhibits and argument on the complaint.
The
case was continued to May 28, 1996, for the purpose of obtaining the testimony
of employees who had filed objections to disclosure of the subject records;
however, prior to the continued hearing date, the complainant submitted a
letter to the undersigned hearing officer stating that he wished to withdraw
his complaint.
The
following order by the Commission is hereby recommended on the basis of the
record concerning the above-captioned complaint:
1. The complaint is hereby dismissed.
