The above-captioned matter was heard as a contested case on November 2, 1994 and January 11, 1995, at which times the complainant and the respondents appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint. During a recess of the January 11, 1995 hearing on this matter, the complainant and the respondents reached an agreement in resolution of this contested case. Thereafter, upon the reconvening of the hearing, the complainant informed the Commission that he wished to withdraw his complaint.

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

1. The complaint is hereby dismissed.
