                        Respondents                 November 23, 1994

 

            The above-captioned matter was heard as a contested case on June 16, August 25 and September 12, 1994, at which times the complainants and the respondents appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint.

 

            After consideration of the entire record, the following facts are found and conclusions of law are reached:

 

            1.  The respondents are public agencies within the meaning of 1-18a(a), G.S.

 

            2.  By letter of complaint filed with this Commission on December 2, 1993, the complainants alleged that the respondents violated the provisions of the Freedom of Information ("FOI") Act by denying their requests for access to certain records on November 24, 1993.

 

            3.  Due to the magnitude and complexity of the records at issue in this case, a fair determination on the merits cannot be accomplished by the statutory deadline of December 3, 1994. 

 

            The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

            1.  The complaint is hereby dismissed without prejudice.
