            The above-captioned matter was heard as a contested case on September 30, 1993, at which time neither the complainant nor the respondent appeared.

 

            The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

            1.  The complaint is hereby dismissed for failure to prosecute.

 

            2.  The Commission notes its staff's attempts to reach the complainant on the morning of the above-referenced hearing to comfirm his intent to prosecute his complaint.  These efforts to reach the complainant were futile.  The unexcused failure of the parties to appear resulted in the waste of public resources, which waste could have been avoided by simple notice to this Commission by the parties to this case.
