            The above-captioned matter was scheduled to be heard as a contested case on July 15, 1993.  Pursuant to 4-177(c), G.S., the parties to this matter have agreed to the following resolution of this case in lieu of a hearing.

 

            Based upon the stipulation of the parties, the following facts are found and conclusions of law are reached:

 

            1.         The respondent is a public agency within the meaning of 1-18a(a), G.S.

 

            2.         The respondent did not file a schedule of its regular monthly meetings with the Allingtown Fire District fire station.

 

            3.         The respondent did not vote at its March 2, 1993 meeting to take up business not contained in its agenda.

 

            4.         The respondent did not vote at its March 2, 1993 meeting before convening in executive session.

 

            5.         The respondent did not make available the minutes of its March 2, 1993 meeting within seven days of the meeting.

 

            6.         The violations of the Freedom of Information Act described in paragraphs 2 through 5, above, were not intentional, and no civil penalty should be assessed against the respondent.

            The parties having consented thereto, the following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

            1.         Henceforth the respondent shall strictly comply with the requirements of 1-21, G.S.
