            The above-captioned matter was heard as a contested case on August 13, 1993, at which time the complainants and the respondent appeared and presented testimony, exhibits and argument on the complaint.

 

            After consideration of the entire record, the following facts are found and conclusions of law are reached:

 

            1.  The respondent is a public agency within the meaning of 1-18a(a), G.S.

 

            2.  By letter of complaint filed with this Commission on April 30, 1993, the complainants alleged that the respondent violated the provisions of the FOI Act by having failed to comply with their April 14, 1993 letter of request for records.

 

            3.  It is found that by letter dated April 14, 1993, the complainants requested the following: all facts and actions concerning the testing and preparation of the body armor displayed and described on April 12, 1993 at the Connecticut legislature as having been penetrated by rifle bullets.

 

            4.  It is found that the respondent had no documentation responsive to the inquiry made by the complainants.

 

            5.  It is concluded that the respondent is not in violation of the provisions of the FOI Act under the facts of this case.

 

            The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint.

 

            1.  The complaint is hereby dismissed.
