            The above-captioned matter was heard as a contested case on March 22, 1993, at which time neither the complainants nor the respondent appeared.  The Commission notes that the complainants waited until the Monday morning of the scheduled hearing into this matter to telephone the Commission to indicate that the matter was not to go forward.  The Commission's position is that the complainants acted unconscionably in permitting the waste of state resources by allowing the hearing officer, in futility,  to prepare for and appear for the hearing into this matter.

 

            The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint.

 

            1.  The complaint is hereby dismissed with prejudice.
