            The above-captioned matter was heard as a contested case on June 5, 1992, at which time the complainant and the respondent appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint.

 

            After consideration of the entire record, the following facts are found and conclusions of law are reached:

 

            1.  The respondent is a public agency within the meaning of 1-18a(a), G.S.

 

            2.         By letter of complaint filed November 27, 1991, the complainant appealed to the Commission, alleging that the minutes of the respondent's September 10, 1991 meeting were not available to the public more than two months later.

 

            3.         It is found that the minutes of the respondent's September 10, 1991 meeting were filed with the New London City Clerk on November 15, 1991.

 

            4.         At the hearing, the complainant without objection amended her complaint to show the customary availability of the respondent's minutes.

 

            5.         It is found that the minutes of the respondent's May 13, 1991 meeting were filed with the City Clerk on June 6, 1991; the July 10, 1991 minutes on July 25, 1991; the August 12, 1991 minutes on August 22, 1991;the January 8, 1992 minutes on January 23, 1992; and the March 9, 1992 minutes on April 9, 1992.

 

            6.         It is concluded that the minutes described in paragraphs 3 and 5, above, were not available to the public within seven days of the meetings, within the meaning of 1-21, G.S.

 

            7.         It is concluded that the respondent violated 1-21, G.S.

 

            8.         At the hearing, the respondent agreed to ensure that the minutes of its meetings would in the future be available to the public in accordance with the requirements of 1-21, G.S.

            The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

            1.         Henceforth the respondent shall strictly comply with the requirements of 1-21, G.S.
