            The above-captioned matter was heard as a contested case on December 3, 1991 and January 10, 1992, at which times the complainant and the respondent appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint.

            The following individuals were granted intervenor status at that time: Adele Saykin, Barbara Larabee, Elaine Hayes, Eileen Garwacki, Carolyn Zeliff, David Shea, Robert Kelleher, Esther Heffernan, Elizabeth Rhoades, Joanne Zarlan, Carolyn Zeane, Alyson Wilk, Cynthia Quartin, Damaris Berkey and Mary Donna Lyons.  The aforementioned individuals are hereby granted party status and designated as respondents.

 

            After consideration of the entire record, the following facts are found and conclusions of law are reached:

 

            1.  The respondent superintendent is a public agency within the meaning of 1-18a(a), G.S.

 

            2.  By letter dated July 3, 1991, the complainant renewed his request to the respondent superintendent for a list of all names and addresses of certified and non-certified employees of the Enfield school system (hereinafter "employees").

 

            3.  By letter dated July 30, 1991, the respondent superintendent partially denied the complainant's request.

 

            4.  By letter of complaint filed with this Commission on August 6, 1991, the complainant appealed this partial denial consisting of thirty-eight withheld addresses.

 

            5.  It is found that through his own efforts, the complainant obtained some of the sought records through other sources prior to the above-referenced hearings.

 

            6.  It is found that at the January 10, 1992 hearing, the complainant withdrew his request for fifteen of the addresses at issue.

            7.  The addresses at issue are public records within the meaning of 1-18a(d), G.S.

 

            8.  In the absence of evidence to the contrary, it is inferred that the requested addresses exist in records other than personnel, medical and similar files, within the meaning of 1-19(b)(2), G.S.

 

            9.  It is therefore concluded that the requested addresses are not exempt from disclosure.

 

            The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint.

 

            1.  The respondent superintendent shall forthwith provide the complainant with the requested addresses for those respondents granted party status herein.
