The above-captioned matter was heard as a contested
case on September 24, 1991, at which time the complainant and the respondent
appeared, stipulated to certain facts and presented testimony, exhibits and
argument on the complaint. Following
the hearing, the hearing officer submitted a Report of Hearing Officer that was
considered by the Commission at its regular meeting of January 8, 1992. At that time, at the request of the parties,
the hearing officer withdrew his report while the parties pursued a settlement
of the case. Subsequently, the
respondent provided the complainant with the records he requested, and the
complainant withdrew his complaint.
The following order by the Commission is hereby
recommended on the basis of the record concerning the above-captioned
complaint:
1. The
complaint is dismissed.
