The above-captioned matter was heard as a contested case on December 19, 1991, at which time only the complainant appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint.
After consideration of the entire record, the following facts are found and conclusions of law are reached:
1. The respondent is a public agency within the meaning of §1-18a(a), G.S.
2. By letter dated August 6, 1991, the complainant alleged that the respondent had failed to comply with his July 22, 1991 request for copies of records for all persons that ever worked at the waste water treatment plant showing for each pay week (a) the regular hours worked, (b) overtime hours worked and (c) other hours for the period 1976 to 1990.
3. It is found that the request was made on July 22, 1991 and that the respondent did not comply.
4. It is found that the requested records are public records within the meaning of §§1-15 and 1-19(a), G.S.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. The respondent shall forwith provide the complainant with the requested records.
