            The above-captioned matter was heard as a contested case on October 15 and October 28, 1991, at which times the complainant and the respondent appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint.

 

            After consideration of the entire record, the following facts are found and conclusions of law are reached:

 

            1.  The respondent is a public agency within the meaning of 1-18a(a), G.S.

 

            2.         By letter of complaint filed July 23, 1991 the complainant alleged that on June 26, 1991, the respondent held an executive session to discuss a personnel matter concerning the complainant without notifying any person that the respondent intended to discuss the complainant.

 

            3.         It is found that the respondent did hold a meeting on June 26, 1991, and that it did hold an executive session to discuss a personnel matter concerning the complainant.

 

            4.         It is found that the complainant was notified that the board would discuss a personnel matter concerning him during a meeting with the superintendent of schools on June 26, 1991 prior to the meeting of the board of education.

 

            5.         It is concluded that the complainant did receive the notice that he would be discussed at the executive session of the board.

 

            6.         It is found that the complainant is knowledgeable concerning his right pursuant to 1-18a(e)(1), G.S., to require that the discussion of personnel matters pertaining to himself be carried on in public.

            7.         It is found that under the circumstances of this case the respondent did not violate the requirements of 1-21 or 1-18a(e)(1), G.S.

 

            The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint.

 

            1.         The complaint is hereby dismissed.
