The above-captioned matter was heard as a contested case on April 25, 1991, at which time the complainant and the respondent appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint. On October 31, 1991, the Commission issued a notice that it would reopen the hearing to give the subjects of any requested personnel, medical or similar files an opportunity to be heard, and to receive any such files for in camera inspection. By letter dated November 12, 1991, the complainant withdrew his complaint.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. The complaint is dismissed.
