The above-captioned matter was heard as a contested case on May 24, 1991, at which time the respondents appeared but the complainant failed to appear to prosecute his complaint. On the date of the hearing, the complainant wrote to the Commission that he believed he had reached an accord with the respondents concerning his complaint. On June 7, 1991, the Commission received a stipulation executed by the complainant and the board of tax review.

This case was consolidated for hearing with contested case Docket #FIC 91-60.

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

1. The complaint is dismissed.
