The above-captioned matter was heard as a contested case on June 14, 1991, at which time the complainant and the respondent appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint.
After the testimony was presented, the respondent agreed that it would ask the employee who is the subject of the requested records whether she objected to disclosure of the records requested by the complainant. If there was no objection the respondent agreed to provide the records to the complainant.
Thereafter, the respondents provided the records to the complainant.
The following order by the Commission is hereby recommended on the basis of the record concerning the above captioned complaint.
1. The complaint is hereby dismissed.
