            The above-captioned matter was heard as a contested case on December 21, 1990, at which time the complainant and the respondent appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint.

 

            After consideration of the entire record, the following facts are found and conclusions of law are reached:

 

            1.  The respondent is a public agency within the meaning of 1-18a(a), G.S.

 

            2.         By letter of complaint dated November 30, 1990, the complainant requested the name(s) and address(es) of the owner(s) of the four branches of American Rental Centers of Connecticut a/k/a American Rental Center located in West Hartford, Fairfield and Waterbury.

 

            3.         It is found that the complainant was denied the requested information on November 27, 1990.

 

            4.         The complainant claims that the requested records are exempt from disclosure pursuant to 1-19(a) and 12-15, G.S.

 

            5.         It if found that 12-15(a), G.S. provides for limitations on inspection or disclosure of tax return information:

 

            The Commissioner, his attorney or agent or any other officer or employee of the state ... shall not make known in any manner any information obtained by an investigation of records or equipment of any person visited or examined in the discharge of official duty; or the amount or source of income, profits, losses, expenditures or any particulars thereof set forth or disclosed in any return, statement or

            report required to be filed with or submitted to the Commissioner; or permit any such return, statement, report or copy thereof or any book containing any abstract or particulars thereof to be seen or examined, except as hereinafter provided.

 

            6.         It is found that no additional provisions in the statutes or regulations applicable to the respondent, permit disclosure of the names and addresses of the owners of businesses.

 

            7.         It is concluded, therefore, that the requested information in exempt from disclosure pursuant to 12-15, G.S.

 

            The following order by the Commission is hereby recvommended on the basis of the record concerning the above-captioned complaint.

 

            1.         The complaint is hereby dismissed.
