Old Lyme Planning Commission,

 

                        Respondent                  June 26, 1991

 

            The above-captioned matter was heard as a contested case on December 10, 1990, at which time the complainant and the respondent appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint.

 

            After consideration of the entire record, the following facts are found and conclusions of law are reached:

 

            1.  The respondent is a public agency within the meaning of 1-18a(a), G.S.

 

            2.         By letter received August 15, 1990, the complainant alleged that the respondent violated the Freedom of Information Act by holding an illegal unnoticed meeting on July 26, 1990.

 

            3.         The respondent claimed that there was no meeting within the meaning of 1-18a (b), G.S., on July 26, 1990.

 

            4.         It is found that the chairman of the respondent and  its planning consultant met with two persons who intended to propose a subdivision on July 26, 1990, but no other members of the respondent were present.

 

            5.         It is found that the discussion concerned procedures to be followed with respect to the proposed subdivision.

 

            6.         It is concluded that the discussion which took place on July 26, 1990 was not a meeting within the meaning of 1-18a(b), G.S.

 

            The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint.

            1.         The complaint is hereby dismissed.
