            against              Docket #FIC 90-14

 

Naugatuck Police Department and State of Connecticut, Department of Public Safety, Division of State Police Labor Relations,

 

                        Respondents,                July 25, 1990

 

            The above-captioned matter was heard as a contested case on May 1, 1990,  at which time the complainant and the respondents appeared and presented testimony, exhibits and argument on the complaint.

 

            After consideration of the entire record, the following facts are found and conclusions of law are reached:

 

            1.  The respondents are public agencies within the meaning of 1-18a(a), G.S.

 

            2.         On November 10, 1989 the complainant requested copies of investigative files, regarding herself and her sons Joseph and Paul, that were maintained by the respondents.

 

            3.         On November 24, 1989, the complainant filed a   complaint with the Commission alleging that the respondent had denied her copies of the requested records.

 

            4.         It is found that no records were provided to the complainant, although the respondents made various efforts to persuade her that no records were maintained by them which would have been responsive to her requests.

 

            5.         At hearing a copy of a single record was provided to the complainant; however, the complainant denied that this was the type of record she was seeking.

 

            6.         It is found that the only other records maintained by the respondents concerning the complainant and her sons are files containing the voluminous correspondence received from the complainant.

            7.         It is concluded that the respondents do not have the records which the complainant has requested.

 

            The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint.

 

            1.         The complaint is hereby dismissed.
