            The above-captioned matter was heard as a contested case on March 19, 1990, at which time the complainant and the respondent appeared and presented testimony, exhibits and argument on the complaint.

 

            After consideration of the entire record, the following facts are found and conclusions of law are reached:

 

            1.  The respondent is a public agency within the meaning of 1-18a(a), G.S.

 

            2.         On several occassions prior to September 20, 1989, the complainant requested copies of records pertaining to the redetermination of his unemployment benefits.

 

            3.         By letter dated September 20, 1990, the complainant was informed by the respondent that he had been provided with all records the department had regarding his unemployment benefits.

 

            4.         By letter of complaint mailed October 5, 1989, the complainant alleged that the respondent failed to provide him with records regarding the redetermination of his unemployment benefits.

 

            5.         It is found that the respondent has no additional records concerning the complainant.

            The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint.

 

            1.         The complaint is hereby dismissed.
