            The above-captioned matter was heard as a contested case on February 6, 1990, at which time the complainant and the respondent appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint.

 

            After consideration of the entire record, the following facts are found and conclusions of law are reached:

 

            1.  The respondent is a public agency within the meaning of 1-18a(a), G.S.

 

            2.  By letter of complaint dated September 21, 1989, and filed with the Commission on September 22, 1989, the complainant alleged that the respondent failed to file the minutes for the East Haven Civil Service Commission's September 7, 1989 regular meeting, (hereinafter "the meeting"), within the seven day time limit set forth in 1-21(a), G.S.

 

            3.  The respondent admits that the minutes for the meeting were not filed until September 26, 1989.

 

            4.  It is found that by failing to file the minutes of the  meeting within the seven days following the meeting date, the respondent violated 1-21(a), G.S.

 

The following order by the Commission is hereby recommended

on the basis of the record concerning the above captioned complaint:

 

            1.  Henceforth the respondent shall act in strict compliance with the provisions of 1-21(a), G.S., pertaining to the requirements for the filing of minutes.

            2.  The Commission notes that if the respondent wished to file either abbreviated or unapproved minutes within the requisite seven days following either a regular or special meeting of the respondent's agency, such a filing would indeed comply with the minutes requirements of 1-21(a), G.S. until such time as a complete, detailed, approved set of minutes were filed.
