The above-captioned matter was scheduled as a contested case on March 9, 1989 at which time the complainant and the respondent appeared.

After an off the record conference, the complainant stated on the record that she did not wish to proceed because she did not want to bring an action which would have impact upon pending lawsuits in which she is involved.

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint.

1. The complaint is hereby dismissed with prejudice.
