                      Respondents                                                November 12, 1986

 

          The above captioned matter was scheduled for hearing September 9, 1986, at which time the parties appeared and presented evidence and argument on the complaint.

 

          After consideration of the entire record the following facts are found:

 

1.       The respondent is a public agency within the meaning of §1-18a(a), G.S.

 

2.       The complainant requested a transcript of a tax abatement hearing on June 18, 1986.

 

3.       On July 30, 1986, the complainant filed a letter with the Freedom of Information Commission concerning the failure of the respondents to provide him with the requested record.

 

4.       §1-21i(b), G.S., provides that an appeal of a denial of a right to receive copies of a public record must be filed within thirty days of the denial.

 

5.       §1-21i(a), G.S., provides that failure to comply with a request to inspect or copy a public record within four business days shall be deemed a denial of the right to inspect or copy such record.

 

6.       It is found that since the denial of the complainant's right to receive copies of a public record occurred more than thirty days prior to the date he filed his complaint that the Commission has no jurisdiction to hear his complaint.

          The following order by the commission is hereby recommended on the basis of the record concerning the above captioned complaint.

 

1.       The complaint is hereby dismissed.
